Terms & Conditions for video uploads

We will use reasonable endeavours to moderate any material that is posted to the "How to guides" section of the Website. Videos published will be chosen at our discretion and will not be published automatically. Not all videos submitted to the “How to guides” section of the Website will be published.

If you fail to abide by these terms and conditions, you accept that we may take any action available to us (and use any information we have about you) to stop any further infringement. This may include informing relevant third parties about the infringement.

You acknowledge and agree that, by uploading a video to the Website, you thereby grant an exclusive, irrevocable, perpetual and royalty-free licence to Imperial Chemical Industries Limited (the "Company") to use and reproduce that video on the Website and in marketing and promotional materials related to the Website, including the Company’s monthly newsletter.

You warrant to the Company that any uploaded video is the result of your original work and that the use and reproduction of the video does not and will not infringe any intellectual property rights owned by third parties. You agree to indemnify the Company in full in relation to any and all losses, costs or expenses which may be suffered by it in connection with any breach of this warranty by you.

You agree that you shall not upload any video or material to the Website that is threatening, defamatory, obscene, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, in breach of confidence or privacy, or which constitutes or encourages conduct that would be considered a criminal offence or an illegal act. You confirm that you have the consent of anyone who is identifiable in your video or the consent of their parent / guardian if they are under the age of 16. You accept that failing to comply with this Condition may result in legal action being taken against you.

You agree that you will not advertise or promote any professional or commercial activities on the Website.

We would advise you never to reveal any specific personal information about yourself or anyone else (for example: telephone number, postal address, home address or e-mail address) in any video uploaded to the Website.

You acknowledge that, unless otherwise stated, the content posted in the “How to guides” section of the Website is created by members of the public. The views expressed are theirs and unless specifically stated are not those of Imperial Chemical Industries Limited (or any of its employees, representatives or affiliated entities). You agree that we are not responsible for any content posted by members of the public on the Website. Any links to third party websites from the Website do not amount to any endorsement of that site by us and any use of that site by you is at your own risk.

You acknowledge and agree that no form of consideration, remuneration or compensation is or may become due to you in connection with any uploaded video.

By uploading a video, you will be deemed to have given your consent to appear in publicity material or other promotional activities related to the Website, which may include the taking of photographs.

We do not warrant that functions available on the Website will be uninterrupted or error free, that defects will be corrected, or that the Website is free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.

To the fullest extent permitted by law, the Company excludes:

a)

all conditions, warranties and other terms which might otherwise be implied; and

b)

any liability for any direct, indirect or consequential loss or damage incurred in connection with the Website, or arising out of the uploading of a video or statement expressed in the “How to guides” section of the Website.

Data protection: the Company is committed to protecting your privacy. Any information or personal data collected in connection with the Website will only be used by the Company or its agents for the purposes of marketing or administering the Website and for future promotions or publicity material relating to the Website.

If any of these terms and conditions is determined to be illegal, invalid or otherwise unenforceable, then to the extent that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and conditions and the remaining terms and conditions shall survive and continue to be binding and enforceable.

The failure or delay by us to exercise or enforce any right in these terms and conditions does not waive our right to enforce that right.

This legal notice shall be governed by and construed in accordance with the laws of England and Wales and is subject to the exclusive jurisdiction of the English courts.
